Kentucky State Senator Brandon Smith was charged on January 6, 2015 with driving under the influence in Frankfort, Kentucky. Senator Smith was administered a field sobriety test but did not provide a breath sample at the jail because he was unable to reach his attorney. The case was tried before a jury and the Senator was found not guilty after the jury deliberated for less than ten minutes.
